kata "Intelektual" tercermin bahwa objek kekayaan intelektual tersebut adalah kecerdasan, daya pikir, atau produk pemikiran manusia ( The Creations of the Human Mind ) ( WIPO, 1988:3 ).

UU yang mengatur Hak Cipta :

• UU nomor 19 Tahun 2002 tentang Hak Cipta.
• UU nomor 16 Tahun 1982 tentang Hak Cipta ( lembaran Negara RI Tahun 1982 Nomor 15 ).
• UU nomor 7 Tahun 1987 tentang perubahab atas UU nomor 6 tahun 1982 tentang Hak Cipta ( lembaran Negara RI Tahun 1987 nomor 42 ).
• UU nomor 12 Tahun 1997 tentang perubahab atas UU Nomor 6 Tahun 1982 sebagaimana telah di ubah dengan UU nomor 7 Tahun 1987 ( lembaran Negara RI Tahun 1997 Nomor 29 ).
 

Tujuan HAKI
1. Memberikan keluasan untuk mencipta tanpa takut dijiplak dan dirugikan secara ekonomi.
2. Merupakan isentif kepada para inventor atas keberhasilan berkarya.
3. Membantu proses promosi dan publikasi terhadap karya intelektual yang baru diciptakan.

 Bentuk-bentuk HAKI

• Patent : merupakan invensi di bidang ilmu, pengetahuan, dan teknologi yang betul-betul baru, dapat memberikan manfaat secara konversial.
• Desain Industri : merupakan hasil karya rancangan bentuk produk, konfigurasi garis, komposisi warna, dan sebagainya yang menghasilkan manfaat fisik dan artistik dan bersifat dapat dilakukan konversial.
• Hak Cipta : merupakan karya cipta di bidang seni, penerbitan, penyiaran, komunikasi masa, melalui berbagai media, antara lain : media cetak, suara, simbul, dan grafika.
• Merek : nama dan logo sebagai ciri pengenal produk, jasa, dan perusahaan guna membedakan dari produk, dan jasa yang dihasilkan oleh perusahaan atau produsen lainnya.
• Tataletak Sirkuit Terpadu : rancangan tata letak komponen-komponen elektronik yang digunakan sebagai bagian dari mesin dan peralatan serta barang-barang elektronika.

Rahasia Dagang ( Trade Secret ) berbeda dari jenis HAKI lainnya. Rahasia Dagang tidak dipublikasikan ke publik. Sesuai namanya Rahasia Dagang bersifat rahasia. Rahasia Dagang dilindungi selama informasi tersebut tidak dibocorkan oleh pemilik rahasia dagang.

Contoh: resep minuman Coca-cola

saingan Coca-cola seperti misalnya pepsi dan RC cola meniru resep tersebut dengan cara menganalisis kandungan dan minuman Coca-cola dan ini masih dianggan legal.

Lisensi adalah izin yang diberikan oleh pemegang Hak Cipta atau pemegang Hak Terkait kepada pihak lain untuk mengumumkan dan/atau memperbanyak ciptaannya atau produk Hak Terkaitnya dengan persyaratan tertentu.
